Police Confirm Self-Defense In Fatal North Carolina Apartment Shooting

Authorities in Winston-Salem have ruled the fatal shooting of a 58-year-old man as an act of self-defense after thorough investigation and consultation with the District Attorney. The person responsible will not face charges, as the evidence supported lawful use of force.

WINSTON-SALEM, NC (2-minute read) — Police in Winston-Salem have closed their investigation into the death of a 58-year-old man, ruling it a justified act of self-defense.

The incident occurred shortly before 1 p.m. on May 31, when officers responded to a 911 call requesting EMS assistance at an apartment on Timlic Avenue. Upon arrival, first responders found Fernando Rodriguez Mendoza dead at the scene. After working with the North Carolina Office of the Chief Medical Examiner, authorities confirmed that Mendoza’s death was the result of a homicide.

However, based on interviews, forensic evidence, and cooperation from all parties involved, the Winston-Salem Police Department concluded that the use of deadly force was legally justified. District Attorney Jim O’Neill reviewed the facts and agreed with investigators that Mendoza’s death fell within the bounds of lawful self-defense. No charges have been filed.

Understanding Self-Defense and North Carolina Law

In North Carolina, individuals have the legal right to use deadly force if they reasonably believe it is necessary to prevent death or serious bodily harm. The state also follows the “Castle Doctrine,” which allows residents to protect themselves within their homes without a duty to retreat. However, the burden of proof still falls on law enforcement to determine whether the use of force was proportionate and justified.

While authorities did not disclose what led to the confrontation inside the apartment, their decision not to file charges indicates that the surviving party likely acted in response to an imminent threat. These cases serve as reminders that owning or using a firearm in self-defense carries immense responsibility and must align with legal requirements.
