A Cincinnati judge has dismissed all charges against 24-year-old Shaquille Ferguson regarding a shooting at Fountain Square after new surveillance video from CityBird restaurant confirmed he acted in self-defense. While the Fountain Square case is dismissed with prejudice, Ferguson still faces separate charges for a shooting in Northside that occurred just days earlier.

On Friday, February 20, 2026, a judge dismissed the charges of felonious assault and improper discharge against the 24-year-old with prejudice, meaning the state cannot prosecute him for this specific incident again. The decision came after internal surveillance footage from the CityBird restaurant proved “crystal clear” that Ferguson acted in self-defense.

The incident, which took place in October 2025, initially led to Ferguson being charged after a 16-year-old and a 19-year-old were wounded in a shootout on Fountain Square. However, the newly reviewed footage revealed that the two teenagers were the ones who drew their firearms first, threatening Ferguson before he returned fire. Ferguson’s attorney, Clyde Bennett, noted that his client had maintained the self-defense claim since turning himself in.

Political Fallout and Ongoing Legal Battles

The Fountain Square shooting served as a flashpoint for public safety concerns in Cincinnati, ultimately contributing to the ousting of Police Chief Terri Theetge. Theetge was placed on administrative leave shortly after the incident as city leadership faced immense pressure to address a perceived “steady drip of violence” in the urban core.

Despite the dismissal in the Fountain Square case, Ferguson’s legal troubles are far from over. He is currently facing separate felonious assault charges for a shooting on Spring Grove Avenue in Northside that took place just two days prior to the Fountain Square encounter. Investigators reportedly connected the two cases after matching shell casings found at both scenes, indicating the same firearm was used.
