“I’m Taking It Regardless”: How A Gas Station Theft Escalated Into A South Side Stabbing

A 43-year-old Circle K employee fatally wounded a 17-year-old boy with a knife early Thursday morning after a dispute over a beer theft turned physical. San Antonio Police Department (SAPD) officials stated the employee claimed he acted in “self-defense” after the teenager struck him during the altercation.


SAN ANTONIO, TX — A routine early-morning shift at a South Side gas station escalated into a violent confrontation on Thursday, April 9, 2026. Just after 5:35 a.m., SAPD officers were called to the Circle K located at Southwest Military Drive and Commercial Avenue following reports of a stabbing.

According to investigators, a 17-year-old male and another individual entered the store and attempted to take beer without paying. When the 43-year-old employee informed the teen that he could not purchase alcohol at that hour, the boy allegedly replied, “I’m going to take it regardless,” and attempted to leave with the beverage.

The Physical Escalation

The situation turned physical when the employee attempted to retrieve the beer. Police report that the teenager struck the employee on the upper body, prompting the clerk to draw a knife and stab the teen in the lower body.

The teenager was transported to a local hospital with non-life-threatening injuries. As of Friday, no arrests have been made, as detectives are currently reviewing the store’s surveillance footage to verify the employee’s claim of self-defense.

Safety Tip: For retail employees and gas station clerks, the legal line between “protecting property” and “self-defense” can be razor-thin. In most jurisdictions, including Texas, the use of deadly force to prevent a simple theft (like a single beer) is often legally indefensible. However, the moment a thief initiates physical violence—as reportedly occurred here when the teen hit the clerk—the scenario shifts from a property crime to an assault. As a safety-conscious employee, your primary goal should always be to avoid a physical struggle over merchandise. If a suspect becomes aggressive, create distance and use your phone as your primary tool. If you are forced to defend yourself, remember that your actions must be proportional to the threat you are facing.
